FCA sets terms of reference for internal review over Andriesz whistleblower case

The FCA has published terms of reference for an internal review into how it handled whistleblowing disclosures from Mr Simon Andriesz, who has since died. The review's scope has widened and its timeline has slipped, with a progress update due January 2027 and a final report in spring 2027.

  • The review is led by Lea Paterson CBE, an independent non-executive director of the FCA, and was commissioned by the FCA's non-executive directors.
  • Scope now includes whether the FCA met its responsibilities under whistleblowing law and followed its own policies and procedures, including handling of Mr Andriesz's detriment concerns.
  • The review covers the period from at least 2017 to 2026.
  • A progress update will be published in January 2027, with the final report expected in spring 2027, later than the previously stated early 2027 target.
  • The review will identify lessons learned and make recommendations for future engagement with external whistleblowers and vulnerable individuals.

ABA's new chair Cathy Owen names digital assets, fraud and cyber as 2026-27 priorities

The American Bankers Association profiles Cathy Owen, its 2026-27 chair and head of Arkansas-based Eagle Bank & Trust. Beyond the personal narrative, the piece sets out the three issues she intends to drive during her term: navigating the digital asset marketplace, and combating fraud and cybersecurity threats. For compliance leaders, it signals where the industry's largest trade body will focus its advocacy.

  • Cathy Owen becomes ABA chair for 2026-27, serving as executive chair of Eagle Bank & Trust and chair and CEO of its holding company.
  • She names digital assets as a top priority, citing goals to protect the marketplace, stay regulatorily compliant, grow thoughtfully and modernise.
  • Fraud and cybersecurity are also on her agenda, with an emphasis on protecting both banks and their customers.
  • Eagle Bank & Trust holds more than $500 million in assets and closed nearly 2,000 mortgage loans last year, all sold into the secondary market with servicing released.
  • Owen was the first female chair of the Arkansas Bankers Association and chaired the board that hired its first female president and CEO.

Public support for CEO activism on social issues continues to slip, surveys show

A review of two new surveys on corporate and CEO activism, published in ABA Banking Journal, tracks shifting public attitudes toward companies speaking out on social and political issues. For bank leadership and communications teams, the data bears on reputational risk management around public statements.

  • Approximately 55% of Americans believe CEOs should be outspoken on issues, down from 65% in 2018, per Stanford/Hoover research.
  • The Bentley-Gallup survey found the share believing businesses should be more vocal on controversial issues ticked down to 47% in 2026.
  • 76% of Americans said they would be less likely to purchase from a company whose CEO spoke out on a disagreeable issue, up 14 percentage points from 2018.
  • 62% of respondents could name a product or service they use less because of disagreement with a CEO's public stance, versus 40% who use one more for that reason.
  • Issues with lowest public support for business statements were religion (16%), abortion (22%), political endorsements (23%) and international conflicts (33%).

DOJ finds Ohio State medical school discriminated against white and Asian applicants

The Justice Department's Civil Rights Division has issued investigative findings against Ohio State University College of Medicine, alleging race discrimination in admissions to its 2023, 2024 and 2025 classes. The findings cite Title VI and the Supreme Court's SFFA decision, and set out the enforcement path: settlement negotiations first, litigation if those fail. Federally funded institutions should read this as the template.

  • DOJ found OSU Med discriminated against white and Asian applicants for its 2023, 2024 and 2025 incoming classes in violation of Title VI and SFFA.
  • Black applicants who were screened and interviewed were about 2.8 times as likely to be admitted as Asian applicants with equal credentials.
  • A 'side door' pathway admitted some applicants without a screener score or interview; in 2024 and 2025 combined, black applicants were four times as likely to be admitted as white applicants, and no Asian applicants were admitted.
  • The Department will pursue settlement negotiations where it finds a violation and will file suit if those efforts fail.

FCA finds uneven conflicts management across private market firms

The FCA has published findings from a review of how private market firms identify, manage and disclose conflicts of interest. Standards varied considerably across private equity, private credit and real estate, with some firms failing to keep controls in step with their own growth. The regulator wants firms to act on the findings, and signals a wider supervisory focus on private markets and investor outcomes.

  • The FCA review covered conflicts of interest and fair customer treatment across private equity, private credit and real estate.
  • Recurring weaknesses were found in cross-fund transfers and multi-party transactions, gifts and entertainment, and information barriers.
  • The FCA expects firms to identify, record, manage and disclose conflicts effectively and to demonstrate investors are treated fairly.
  • Separately, the FCA is examining governance and conflicts concerns relating to the use of private credit to fund consumer litigation claims.

US banks turn to podcasts for marketing as listenership reaches 158 million

The ABA Banking Journal profiles how community and regional banks use podcasting as a marketing and relationship tool. It draws on practitioners at South State Bank, Sunrise Banks and the former Keystone Bank, covering why they launched, how they measure results and what separates shows that gain traction from those that stall. A short, practical read for marketing and communications leads.

  • RSS.com data cited in the piece puts US monthly podcast listeners at more than 158 million, about half of Americans aged 12 and over.
  • Grandview Research forecasts the US podcasting market will grow by about 19 percent between 2025 and 2030.
  • South State Bank's The Community Bank Podcast now averages about 3,500 downloads per month, up from roughly 500 at its 2020 launch.
  • Practitioners stress defining a target audience and keeping production lean, with Sunrise Banks describing a setup of "a Yeti mic and then some graphic designer's time."
  • There are approximately 4.5 million podcasts registered worldwide, making intentional promotion necessary to capture attention.

FCA signs lease for new Leeds office, relocating in 2028

ICC judges amend Code of Judicial Ethics on social media and enforceability

The International Criminal Court has amended its Code of Judicial Ethics, binding on sitting judges, to address social media conduct and to clarify that the code's standards are enforceable. The change took effect immediately on publication. This briefing sets out what the two amended articles now say and what it means for how judicial conduct is assessed.

  • The revised Code of Judicial Ethics entered into force on 16 October 2026, upon publication on the ICC website.
  • Judges agreed the amendments at a Judges' Retreat held on 29 September 2026, under regulation 126 of the Regulations of the Court.
  • A new sub-paragraph 3 to article 10 requires judges to exercise caution when using social media and other information technologies.

FCA survey of 411 corporate finance firms finds weakest spots in compliance culture

The FCA has published findings from a survey of corporate finance firms' compliance resources, flagged in its Regulatory Priorities Report. Most firms perform core compliance tasks, but the regulator wants to see more independent challenge and better-embedded compliance culture, particularly in small firms and those playing public-markets roles. If you run second-line functions in wholesale advisory firms, this sets the benchmark the FCA will apply when it engages selected firms next.

  • The FCA surveyed 411 corporate finance firms and received 382 responses; 47% reported carrying out all activities covered by the survey.
  • 140 firms reported that regulatory compliance does not form part of staff performance assessments, and 90 reported no whistleblower disclosure arrangements.
  • 82 firms each reported that compliance does not attend management body meetings and does not report at least annually to the management body.
  • 63% of firms reported a compliance function that is not dedicated solely to compliance, and 90% used some form of third-party compliance support.
  • The FCA will engage selected firms further to examine the adequacy and effectiveness of their compliance resources and gaps in practice.
